Judgment, not prejudgment

Litigants—including Mr. Trump—have a right to appear before judges who have not prejudged the case or the person.

Michael J. Broyde, The Case for Ginsburg to Recuse Herself

Half true, half dubious if not lie. Litigants have a right to appear before judges who have not prejudged the case, but I know no reason why a Justice who recognizes what a horrid person Donald Trump is cannot prescind that recognition from the merits of a case that affects the whole nation, in whose name Trump is acting.

Let’s face it: every Justice of the high court knows that Trump is a narcissist, maybe a sociopath, and unfit for office. Ginsburg shouldn’t have said what she said, but she is not an outlier in the judgment department, and it’s not pre” judgment any more.
